It seems to me David Cassidy is being cheated. I have the Johnny Lightning Partridge Family bus. I don't think David will get paid alot but I do believe they owe him something.
Unfortunatly I don't think he will get paid what was owed him for merchandise royalties in the past.

It's interesting to learn that since he owned a piece of the show, he's due royalties from anything & everything, even if it did not include his likeness. If he's owed one penny, he should get it, plus interest. I just hope they settle, and fast. Maybe then, he'll stop being so damned bitter and prickly. Ahhh -- one can dream. Laughing

I do not think this suit included music royalties, so I doubt it will affect his willingness to release to lost material. His manager still thinks we want new recordings of him singing the unreleased stuff instead of the original 1970-1974 recordings. Shocked

I am surprised there isn't any statute of limitations on the time when a suit like this can be filed. Why did he wait so long? He's saying that he JUST found his contract NOW? 44 years later? If he was so hell-bent on getting his money and he didn't have his contract (until NOW??!!) then why didn't his lawyers file suit with Sony for a copy of his original agreement? AND, if I have a copy of his renegotiated contract, why did he?? Laughing Laughing Laughing

I really hope he gets all of the money owed him. Well, except for those "love stickers." Those were just plain dumb. Laughing

His manager is wrong! I'd much rather have the original recordings than have David rerecord them now. He sounded better on the originals!

I agree. I absolutely would not buy any new re-recordings! The magic of the originals just wouldn't be there.

While I feel for him, and agree that if they owe him money, he should get it, I do question about the statute of limitations on this.
Also, this is a lot of years to go tracing back. Through a lot of company changes and record keeping changes.
Is it even possible to figure it all up correctly after all this time?

Obviously, it should have been done right from day one, but seems to me that this is going to be nightmare no matter how you look at it.

I doubt anybody is sure what is out there anymore and it could be back and forth forever.

You would think that he has waited to long to deal with this....but then Happy Days cast recently filed suit, so...? Perhaps recent issuing of merchadise, if there has been any, keeps the contract alive. I have no idea.

It's possible that there were different contracts for different aspects of the show, i.e., a music contract, and "acting" contract, a merchadising contract. Mayhap he lost the one that deals with merchadising. In any case, I agree that he could have requested one from Sony at any time. It's all a little strange.

I believe what spurred the cast of "Happy Days" to file suit was the new merchandise, such as casino slot machines, that had their likeness. It was then that they compared notes with each other and realized they were never paid for stuff from the 70s either. What bothers me, is Sony stating that they can't find records dating back to the 70s. If that's the case, what happens to the lawsuit that DC has filed? If there are no records, how can it move forward?

If a company such as Sony is so poor at (air quotes) keeping records, might a judge side with the plaintiff and appoint some kind of independent auditor to assess what these stars should be paid? I wonder... Question

isn't Sony the owner of the Partridge Family by acquisition? Screen Gems was the original distributor of the TV show and Columbia the owner of the music catalog, if I remember correctly, and both were acquired by Sony later. If that's the case it's very possible some records got misplaced in the shuffle. (Not saying that's what happened, of course, but I've had medical records go missing when two clinics merged, and they haven't been found in the past 13 years.)

Screen Gems was a division of Columbia Pictures Television. They produced the series, and many other sitcoms in the 60s and early70s. By the mid 70s, Screen Gems was renamed Columbia Pictures Television. Bell Records was the music producer. Columbia Pictures acquired Bell Records in the late 60s, I believe so it was all in the family as far as the series, records, music publishing, etc. goes. Bell became Arista Records sometime around 1974 when Clive Davis bought partial ownership and combined the various other record labels owned by Columbia Pictures, into one label (Arista).

Columbia Pictures (including Screen Gems) was sold to Coco Cola at one point, then Sony acquired the studio afterwards.

So, it's possible some records got lost on the shuffle but you'd have to assume that they'd be extremely careful in not misplacing legal documents when they might need them down the road -- not so much in cases like this, but in cases when their own ownership and rights come into question.
